Can it be used suspended underwater, near the surface? Will it read accurately between 30 and 40F?

Ours is suspended 5 feet under water. We haven't tested the accuracy but it does seem to be accurate. We have had it only since beginning of summer, so do not know about reading between 30 and 40. We plan to pull up for winter.

Is the cable between the lcd display and the probe flexible? can the unit be paired with a smart phone app?

It is a flexible coated cable from the Display/antenna unit to the stainless steel probe. To view data remotely via smartphone requires Ecowitt GW1000, GW1100, or other specific Ecowitt console with wifi connection.
