The lights stay on only if the mode button stays pressed. It won’t stay lit otherwise. Is the button defective?

My lights stay on if the mode button is pushed or not....often it is not dark enough for the lights to light up.....so cannot change mode until it gets dark....to get the mode that I wanted, I had to bring the lights where it was dark (inside) like the garage or a small bathroom and try out the various modes til I got the one I liked....then put them back outside. I keep them away from any outside lights so they really show up . The remote that came with these lights does not work really well unless it is right next to the charging sensor.
