Get a damp towel and lay it where you want it and then lay the heating pad over top. Relax.

Is the heating element in the neck?

Yes, but just in the center section, not all the way to the sides. Would be nice if it wrapped all the way around, but still you do feel the heat in your neck, and overall I absolutely love this thing. Gets very warm, which is the highlight for me.
